Families in Athens, Georgia benefit from federal and state laws that protect the rights of autistic individuals and ensure access to diagnosis, treatment, and education.
Georgia Insurance Mandate
Georgia law requires commercial health insurers to cover autism diagnosis and treatment, including ABA therapy, for individuals under 21. There is no annual cap on ABA services. This mandate applies to fully insured plans; self-funded employer plans may not be covered by the state mandate but may offer voluntary coverage.
Educational Rights
Under IDEA, children with autism in the Clarke County School District are entitled to free appropriate public education through IEPs. Georgia’s special education protections meet or exceed federal requirements. Parents have the right to request evaluations, participate in IEP development, and dispute decisions through mediation or due process.
ADA and Civil Rights
The ADA protects autistic individuals from discrimination in employment, public services, and public accommodations. The University of Georgia, a major Athens institution, provides disability services for autistic students. Public spaces must be accessible, and employers must provide reasonable accommodations.
Medicaid and Waivers
Georgia Medicaid covers ABA therapy. The NOW and COMP waivers provide additional services. Athens families can apply through the DBHDD regional office serving northeast Georgia.
